1. Agreement to these Terms
These Terms of Use (“Terms”) govern your access to and use of klok.global and any related pages, downloads and content (the “Site”), operated by Klok LLC (“Klōk,” “we,” “us” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
2. The Site and our products
The Site provides information about Klōk products and services, whitepapers, and support resources. The purchase and use of Klōk devices and services are governed by separate written agreements between Klōk and its customers or authorized resellers. If those agreements conflict with these Terms, those agreements control.
3. Permitted use
You may use the Site for lawful purposes and for your own informational or business use. You agree not to:
- use the Site in any way that violates applicable law or regulation;
- attempt to gain unauthorized access to the Site, its servers or any connected systems;
- interfere with or disrupt the Site, including by introducing malware or by excessive automated requests;
- copy, scrape, reproduce or redistribute Site content for commercial purposes without our written permission; or
- misrepresent your identity or affiliation when contacting us.
4. Intellectual property
The Site and its content — including text, graphics, logos, product images, whitepapers and the Klōk name and marks — are owned by or licensed to Klōk and are protected by intellectual property laws. You may download and share our whitepapers in unmodified form for non-commercial informational purposes, with attribution to Klōk. No other license is granted.
5. Information you submit
If you contact us or request a briefing, you agree that the information you provide is accurate. Our use of that information is described in our Privacy Policy.
6. Third-party links
The Site may link to third-party websites. We do not control and are not responsible for their content or practices.
7. Export and compliance
Klōk products and technical information may be subject to U.S. export control and sanctions laws. You agree not to use the Site or its content in violation of those laws.
8. Disclaimers
The Site and its content are provided “as is” and “as available,” for general information. We make no warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose or non-infringement. Product descriptions and specifications on the Site are subject to change and do not form part of any contract unless incorporated in a written agreement.
9. Limitation of liability
To the fullest extent permitted by law, Klōk will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or business, arising from your use of the Site. Our total liability relating to the Site will not exceed one hundred U.S. dollars (US$100).
10. Indemnity
You agree to indemnify and hold Klōk harmless from claims arising out of your misuse of the Site or your violation of these Terms.
11. Changes
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Site means you accept the changes.
12. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.
